Summary

EPA alleges that Respondent violated Section 301(a) of the Clean Water Act by discharging stormwater associated with industrial activity into waters of the United States without having obtained proper permit authorization and by discharging process wash water into waters of the United States without having obtained proper permit authorization from specified facilities in New England, during specified times, as described in the Agreement. In addition, EPA alleges that Respondent violated Section 311(j) of the Clean Water Act by failing to develop, maintain, and implement a Spill Prevention, Control and Countermeasure Plan at two specified facilities in New England, as described in the Agreement.
