EPA Region 2 alleges that Respondent violated Section 301 (and 402) of the CWA by discharging stormwater associated with construction activity to a Water of the United States at the Singh SFR construction site in Warren, NJ without complying with the New Jersey Department of Environmental Protection’s New Jersey Pollutant Discharge Elimination System (“NJPDES”) General Permit for Stormwater Discharges from Construction Activities (“5G3”) .
