Summary

30-Day Public Comment Period on No Further Action Decision

The U.S. Environmental Protection Agency (EPA) Region 7, in consultation with the Winnebago Tribe of Nebraska, Ho-Chunk, Incorporated and the Nebraska Department of Water, Energy and Environment, has determined that no further action is needed at the Pony Express Leaking Underground Storage Tank (UST) site, located at 143 US-77, Winnebago, Nebraska, 68071.

During routine inspection, maintenance and monitoring, petroleum contamination from a leaking UST component was discovered in the soil. Following a Resource Conservation and Recovery Act (RCRA) Subtitle I environmental investigation, a risk-based corrective action (RBCA) evaluation showed that no further work was required, and the LUST contamination does not pose a risk to public health and the environment. Petroleum soil contamination remains on/under the site. These contaminant conditions were factored into the RBCA No Further Action decision. Future land uses will need to accommodate the conditions noted in the administrative record (AR).

EPA invites the public to review the AR and provide comments regarding the No Further Action decision documents, through September 25, 2026. The AR is available at the following locations during normal business hours:

A public meeting or public hearing is not scheduled at this time. EPA may conduct a public meeting or hearing if the public requests one in writing, with a statement of the substantive issues to be raised at the meeting/hearing.
