Summary
EPA Region 2 alleges that Respondent violated Section 301 (and 402) of the CWA by discharging stormwater associated with construction activity to a Water of the United States at the Tuxedo Reserve construction site in Tuxedo Park, NY without complying with the New York State Department of Environmental Conservation State Pollutant Discharge Elimination System (“SPDES”) General Permit for Stormwater Discharges from Construction Activities (“CGP”).
