Albuquerque SIP: Reg 21. Permit Fees: SIP effective 1980-04-10 (NMc11) to 2012-06-24 (NMd39)

SECTION 21.  PERMIT FEES
Approved by EPA 04/10/80 (45 FR 24468) at 52.1620(c)(11) effective 04/10/80.

21.01   Every applicant, except federal, state or any local governmental agency, who files an application for an initial Authority to Construct Permit for a change which results in the increase of the amount of any air contaminant emitted by such source or reduces emissions from such source not in compliance with existing regulations or results in the emission of any air contaminant not previously emitted shall pay the fee prescribed in the fee schedule below. Applicants in compliance who file for an Authority to Construct Permit for modification which reduces emissions of air pollutants will be exempt from fee payment.

H - Crematories and Pathological Destructors   75.00
I - All Others  150.00




21.02   Where an application is filed for an Authority to Construct Permit for any stationary source by reason of transfer from one location to another, and where a permit had previously been granted under Section 20 (Regulation No. 20) and except for location the information given in subsection 20.04 is still valid, the applicant shall pay only a $10.00 transfer fee.

21.03   Where an application is filed for an Authority to Construct Permit and where a permit had previously been granted for such equipment under Section 20 (Regulation No. 20) and a modification will be made, the applicant shall be assessed a permit fee based upon the ratio of the cost of modifications over the original cost, but shall not be less than $25.00 or more than 100 percent of the applicable fee.

21.04   Any fees required herein shall not be refunded.
