New Mexico State-Wide SIP-Approved Regulations Background Information
July 1998 to present
New Mexico State reformatted the regulations in 20 NMAC, Chapter 2, to be consistent with the rest of the regulations in the New Mexico Administration Code but apparently never submitted the reformatted regulations to EPA as a SIP revisions. The more recent SIP-approved State-Wide in this web site regulations are in the new format whereas the previously SIP-Approved rules are in the format shown below.
Air Quality Control Regulations in New Mexico SIP as of July 1998
With the exception of Part 74 (Prevention of Significant Deterioration), the New Mexico State SIP regulations shown in this directory were approved by EPA September 26, 1997 (62 FR 50514 to 50518) effective November 25, 1997. The regulations were renumbered and reformatted into the New Mexico Administrative Code (NMAC) as required by the New Mexico State Records Center. In addition to having renumbered and reformatted the regulations, standard administrative changes were made throughout all AQCRs, and revisions made to seven particular AQCRs. Part 74 was approved by EPA October 15, 1996 (61 FR 53639), at 52.1620(c)(62) effective December 16, 1996. These regulations replaced the New Mexico State Air Quality Control Regulations (AQCRs) in the New Mexico SIP. The old AQCRs are listed below.
The NMAC system is divided into Titles, Chapters, Parts and Sections. Title 20, Environmental Protection, includes all rules and regulations providing for the protection of the environment. Chapter Two of Title 20, Air Quality (20 NMAC 2.), contains the revised and recodified AQCRs of the NMEIB. Chapter Two is divided into Parts, which are further divided into Sections. The resulting NMAC for air quality is of the format: 20 NMAC 2.xxx.yyy, where xxx is the Part number and yyy is the Section number. Longer Parts have been divided into Subparts. RESERVED has been added to all nonexistent sections between subparts.

Section 108, DOCUMENTS, has been added to some parts. Section 108 cites documents other than the NMAC, such as 40 Code of Federal Regulations (CFR). All sections above are in Subpart I, GENERAL PROVISIONS, in Parts that have been divided into Subparts. In the regulations in this directory, the AQCR(s) the Part replaced is given in brackets after the title of the Part.
