§101.03.  Circumvention.
(Approved as Rule 4.)

(Section 101.3 approved by EPA as Rule 4 on 05/31/72 (37 FR 10895) at 52.2270(b) [indicated by “01" below] effective 05/31/72.)

01    No person shall use any plan, activity, device or contrivance which the Executive Director determines will, without resulting in an actual reduction of air contaminants, conceal or appear to minimize the effects of an emission which would otherwise constitute a violation of the Act or regulations.  Air introduced for dilution purposes only is considered a circumvention of the regulations.
