Chapter 116 – Control of Air Pollution by Permits for New Construction or Modification
SUBCHAPTER I : ELECTRIC GENERATING FACILITY PERMITS
All sections in this SIP-approved compilation of Subchapter I except Section 116.919 are as adopted by TNRCC December 16, 1999 effective January 11, 2000 (6-53) OR as adopted by TNRCC May 22, 2002 effective June 12, 2002 (6-58).
All sections except Section 116.919 approved by EPA January 11, 2011 (76 FR 1525) effective February 10, 2011 (TXd124), Regulations.gov ID: EPA-R06-OAR-2005-TX-0031 [Short ID: TX037]
Section 116.919 in this compilation is as adopted by TCEQ August 21, 2002 effective September 12, 2002 (6-60), and approved by EPA January 6, 2014 effective February 5, 2014 (TXd147), Regulation.gov docket EPA-R06-OAR-2011-0202 [TX117].
Section 116.915 as adopted by TNRCC August 7, 2002 in not in the SIP.
Section 116.911 as approved by EPA January 11, 2011 (76 FR 1525) effective February 10, 2011 (TXd124), did not include paragraph 116.911(a)(2) in the SIP. A revision to Section 116.911 approved by EPA April 1, 2014 (79 FR 18183) effective June 2, 2004 (TXd157), Regulations.gov docket EPA-R06-OAR-2014-0191 [TX157], changed the status of paragraph 116.911(a)(2) from “[Section] 116.911(a)(2) is not in the SIP” to “Section 116.911(a)(2) is authorized for Minor NSR only”.
Errors in the amendatory language in the January 11, 2011 (76 FR 1525) (TXd124) Federal Register -- In the amendatory language (and codification in the U.S. Code of Federal Regulations in 40 CFR 52.2270(c )) beginning on page 76 FR 1531 there are errors in the titles of Sections 116.911, 116.912, 116.917, 116.918, and 116.930, and the title of Section 116.920 is completely wrong. The titles are correct in the outline below.
