Alternative Dispute Resolution

ADR refers to voluntary techniques for resolving conflict with the help of a neutral third party. Resolving conflict through the use of ADR can have many benefits including: faster resolution of issues and more creative, satisfying and enduring solutions. 

Is ADR available to parties that appear before the EAB? 

The Environmental Appeals Board encourages parties to engage in ADR to resolve disputes before the Board. To that end, the EAB offers an Alternative Dispute Resolution (ADR) program.  The EAB's ADR program is voluntary, and to pursue the program, all parties need to agree to participate.  See  Agreement to Participate in EAB's ADR Program (pdf) (140.71 KB) .  The EAB’s ADR process is conducted in accordance with the  Alternative Dispute Resolution Act of 1996 (pdf) (185.91 KB) .  In most cases, the Board offers parties the option of participating in ADR with the assistance of an EAB Judge acting as a neutral evaluator/mediator.  The primary purpose of the EAB’s ADR program is to provide a neutral, confidential forum for the settlement of cases before the Board.

Is there a cost for ADR under the EAB Program?

There is no charge to either side in connection with ADR under the EAB Program.
