Clean Water Act Hazardous Substance Worst Case Discharge Planning Regulations

EPA proposed new requirements for certain facilities to plan for worst case discharges of Clean Water Act (CWA) hazardous substances. A worst case discharge is the largest foreseeable discharge in adverse weather conditions, including those due to climate change.

Proposed Rule on CWA Hazardous Substance Worst Case Discharge Planning

On March 10, 2022, EPA Administrator Michael Regan signed the Proposed Rulemaking on CWA Hazardous Substance Worst Case Discharge Planning. The public comment period on the proposed rule closed on July 26, 2022.
