Clean Water Act Hazardous Substance Facility Response Plans

  • New Planning Requirements

    On March 14, 2024, EPA finalized planning requirements for worst case discharges of hazardous substances.

Certain facilities are required to plan for worst case discharges of hazardous substances under the Clean Water Act. A worst case discharge is the largest foreseeable discharge in adverse weather conditions, including extreme weather conditions due to climate change.

    The planning requirements apply to facilities that could reasonably be expected to cause substantial harm to the environment, based on their location.
