Are Oral Arguments Open to the Public?
Yes, oral arguments are open to the public and are held in person in the Administrative Courtroom, U.S. Environmental Protection Agency, William Jefferson Clinton Federal Building East, Room 1152, 1201 Constitution Avenue, N.W., Washington, D.C. 20004. A party may also appear via videoconference.
Oral arguments are also live streamed to the public. A few days prior to an oral argument, the Board will provide a link to the argument on this webpage under "Upcoming Oral Arguments". Members of the public interested in observing the oral argument proceeding virtually can do so by clicking on the appropriate link to join the live streamed argument.
How can I observe Oral Arguments?
You can request to attend the argument in person or observe the argument virtually.
Advance notice is required for in person attendance to gain entry into the EPA building where the Courtroom is located. You will be required to pass through a magnetometer, and your bags will be screened by an x-ray machine. You are required to show a photo ID issued by a government agency, e.g., a valid driver’s license. Members of the public wishing to attend an oral argument held in the Administrative Courtroom should notify the Clerk of the Board at least one week prior to the oral argument to allow the Clerk reasonable opportunity to notify appropriate security personnel.
To observe an oral argument taking place virtually, follow the link available on this page under “Upcoming Oral Arguments.” Observers will be required to have their cameras turned off and their microphones muted.
Who do I have to contact to request accommodation?
Any party or member of the public interested in attending an oral argument, in person or virtually, who requires an accommodation due to a disability should notify the Clerk of the Board at least one week prior to the oral argument. The Clerk of the Board can be reached either by emailing Clerk_EAB@epa.gov, or by calling 202-233-0122.
