Public Notice: Proposed Settlement with Stella-Jones Corporation for Alleged Clean Water Act Violations in Oregon

EPA alleges that the respondent's Spill Prevention, Control, and Countermeasure plan lacked several required elements, including complete diagrams displaying tank contents and connecting pipes, secondary containment descriptions, and updated emergency response contact information. EPA also alleges that several staff were overdue in annual SPCC training and annual discharge prevention meetings were not conducted.
The settlement agreement also alleges that inspection records did not adequately document tank-related issues and corrective actions were not documented. Lastly, EPA alleges that a tank was found to be actively leaking at the time of inspection.
This action is being simultaneously commenced and concluded in a Consent Agreement and Final Order. Under the proposed agreement (see "related documents" below), the Stella-Jones Corporation will pay a civil penalty of $98,000.
