Update on TSCA Risk Management Rule for Perchloroethylene

U.S. Environmental Protection Agency (EPA) is providing an update on its reconsideration of the final risk management rule for perchloroethylene (PCE) under the Toxic Substances Control Act (TSCA). As noted in the November 28, 2025 declaration to the court, EPA expects to publish a Notice of Proposed Rulemaking to amend the 2024 PCE Rule in or around summer 2026 and publish a final rule in 2027. EPA is also considering options for extending certain compliance dates established by the 2024 PCE Rule, including options involving a more expedited rulemaking process to address compliance date extensions. This reconsideration is being done in accordance with applicable law, Executive Orders, and Administration policies, including  Executive Order 14219 “Ensuring Lawful Governance and Implementing the President’s ‘Department of Government Efficiency’ Deregulatory Initiative” and the EPA’s Powering the Great American Comeback Initiative Pillar I: Clean Air, Land, and Water for Every American. 

After the 2024 PCE Rule was published, several legal challenges were filed. These petitions for review were consolidated in the Court of Appeals for the Fifth Circuit. The Court previously granted a temporary abeyance while EPA conducts a rulemaking to reassess the challenged rule and ordered EPA to update the Court with its plans for issuing a new rule. 

In late July, EPA opened a 30-day public comment period on the 2024 PCE Rule. EPA is now considering these comments and other reasonably available information as it moves forward in developing its proposed rule. EPA plans to solicit public comment on its Notice of Proposed Rulemaking to amend the 2024 PCE Rule, which will inform the final rule.
