Rule Summary

On February 26, 2026, EPA approved Kentucky’s 2025 petition to opt-out of the federal reformulated gasoline (RFG) program for Jefferson County and the parts of Bullitt and Oldham Counties in Louisville, Kentucky. EPA has determined that removing the RFG program for the Kentucky portion of the Louisville Area is consistent with the applicable provisions of the Clean Air Act (CAA) and EPA’s regulations. Effective May 27, 2026, the Kentucky Portion of the Louisville Area will not be a “covered area” in the federal RFG program. Retailers, wholesale purchaser-consumers, refiners, importers, and distributors will no longer be required to supply reformulated gasoline to this area.

On February 28, 2025, Kentucky submitted a petition to EPA requesting to opt-out of the RFG program for the Louisville Area. Kentucky submitted supplemental information on August 4, 2025, to support its opt-out petition. 

On February 26, 2026, EPA signed a Federal Register notice notifying the public that the agency had approved Kentucky’s petition. The Federal Register notice establishes May 27, 2026 as the effective date of the approval — which is 90 days from EPA’s written notification to the Commonwealth approving the RFG opt-out request. The 90-day timeframe is required by EPA’s regulatory obligations.
