Final Action

The United States Environmental Protection Agency (EPA), Region 9, is approving a Request for Coverage under the General Air Quality Permit for New or Modified Minor Source Gasoline Dispensing Facilities in Indian Country within California (CA-GDF General Permit) from the Cabazon Band of Cahuilla Indians. This approval pertains to the construction and operation of the Cahuilla Springs Trading Post (Source), a gasoline dispensing facility (GDF), to be located on the Cabazon Reservation in Coachella, California. The EPA is approving the Source’s request pursuant to the provisions of Clean Air Act (CAA) sections 110(a) and 301(d) and the EPA’s Federal Indian Country Minor New Source Review (NSR) Program at Code of Federal Regulations (CFR) title 40, sections 49.151-165 (Tribal Minor NSR Program).

The EPA Region 9's approval of the Request for Coverage for the Source under the CA-GDF General Permit is a final agency action for purposes of judicial review only for the issue of whether the Source qualifies for coverage under the CA-GDF General Permit. See 40 CFR 49.156(e)(6). Any petition for review of this approval action must be filed in the United States Court of Appeals for the appropriate circuit pursuant to CAA section 307(b). This Approval is effective as of July 8, 2026.
