Summary

The Environmental Protection Agency (EPA) is providing notice of a proposed administrative penalty settlement with Mercedes & BMW Auto Parts (Respondent) for violations of the Clean Water Act (CWA). EPA alleges that Respondents violated CWA Section 301(a), 33 U.S.C. § 1311(a), by discharging industrial stormwater into waters of the United States without obtaining a permit. Specifically, EPA alleges that the company’s Sun Valley facility discharged industrial stormwater to the Los Angeles River and its tributaries from December 2025 through March 2026 without authorization.

Pursuant to Section 309(g) of the CWA, 33 U.S.C. § 1319(g), and in accordance with 40 C.F.R. Part 22 (consolidated rules of practice for assessing administrative civil penalties), EPA proposes entering into a consent agreement with Respondent, referred to here as an Expedited Settlement Agreement, which will simultaneously commence and conclude this CWA Class I civil administrative penalty proceeding. In accordance with the Expedited Settlement Agreement process, Respondent has already sought coverage for the facility’s stormwater discharges under the Industrial General Permit and has agreed to pay the United States a civil penalty of $1,500 to resolve this matter.
