Summary

The U.S. Environmental Protection Agency (EPA), Region 5, is providing notice of intent to execute an Expedited Settlement Agreement (ESA) with Charles Industries, LLC (“Respondent”) for alleged violations of the Clean Water Act (CWA). EPA alleges that Respondent improperly sampled wastewater, omitting one of the waste streams in the final effluent from the samples and collecting samples using 12-hour time proportional composite sampling techniques rather than the required 24-hour flow proportional composite sampling techniques, in violation of 40 C.F.R 403.12 § (g)(3).

EPA and Respondent have agreed that Respondent will pay a civil penalty of $750. Full payment of the penalty will resolve Respondent’s liability for federal civil penalties for the violation alleged in the ESA.
