Public Notice: United States Environmental Protection Agency Region 6, Dallas, Texas Proposed Modification Approval For Storage And Disposal of Polychlorinated Biphenyls (PCBs) At Veolia Es Technical Solutions, LLC, Jefferson County, Texas
Summary
The United States Environmental Protection Agency (EPA) Region 6 office in Dallas, Texas, proposes to modify the existing PCB approval for Veolia ES Technical Solutions, LLC, located in Jefferson County, Texas. Veolia ES Technical Solutions, LLC, has requested approval to continue operating its existing PCB treatment, storage, and disposal facility under the updated conditions.
EPA has authority to issue approvals for commercial storage and land disposal of PCBs under Section 6(e) of the Toxic Substances Control Act (TSCA) in accordance with 40 CFR §761 Subpart D. EPA most recently renewed Veolia’s PCB incinerator approval pursuant to 40 CFR § 761.70 on April 23, 2024, and established incinerator operating limits based on a 2025 trial burn. Veolia submitted information on June 30, 2026, requesting revisions to certain of those incinerator operating limits. EPA proposes to approve Veolia’s request and revise certain incinerator operating limits until new limits are established through the next PCB trial burn, which is scheduled in September 2027. This notice opens a 30-day comment period, beginning 10/26/2026 and ending 11/26/2026, during which requests may be made for a Public Hearing. The decision to hold a hearing is at the discretion of the EPA and will be based on factors such as the degree of public interest, the substance of comments, and whether a hearing is needed to clarify relevant issues.
