Summary

The U.S. Environmental Protection Agency, Region 9 (EPA) is issuing a notice of proposed action under the Clean Water Act (CWA). EPA is proposing to issue a National Pollutant Discharge Elimination System (NPDES) permit NN0029386 to:

24 miles NW of Gallup on State Highway 264
Gallup, NM 87305

Permittee:
Chevron Mining, Inc.
1400 Smith Street
Houston, TX 77002

The permit authorizes the discharge of stormwater from McKinley Mine to the Coal Mine Wash, Defiance Draw, and Tse Bonita Wash, which are tributaries to the Puerco River. Chevron Mining Inc. operates the mine which has no active mining, is in full reclamation and is in the process of achieving Phase III Bond release.
