Public Notice: Agua Caliente Fuel Palm Springs; Approval of Request for Coverage under General Air Quality Permit
Summary
The United States Environmental Protection Agency (EPA), Region 9 is approving a Request for Coverage under the General Air Quality Permit for New or Modified Minor Source Dispensing Facilities in Indian Country within California (CA-GDF General Permit) from the Agua Caliente Tribal Corporation (Applicant). This approval pertains to the construction and operation of the Agua Caliente Fuel Palm Springs (Source), a proposed gasoline dispensing facility (GDF) to be located on the Agua Caliente Band of Cahuilla Indians of the Agua Caliente Indian Reservation, in Palm Springs, California. The EPA is approving the Source’s request pursuant to the provisions of Clean Air Act (CAA) sections 110(a) and 301(d) and the EPA’s Federal Indian Country Minor New Source Review (NSR) Program at Code of Federal Regulations (CFR) title 40, sections 49.151-161 (Tribal Minor NSR Program).

EPA Region 9’s approval of the Request for Coverage for the Source under the CA-GDF General Permit is a final agency action for purposes of judicial review only for the issue of whether the Source qualifies for coverage under the CA-GDF General Permit. See 40 CFR 49.156(e)(6). Any petition for review of this approval action must be filed in the United States Court of Appeals for the appropriate circuit pursuant to CAA section 307(b). This Approval is effective as of April 8, 2025.
