Public Notice: McKittrick Limited, Bakersfield, California; Proposed Settlement of SDWA Underground Injection Control Administrative Penalty
Summary
In accordance with Section 1423(c)(1) of the Safe Drinking Water Act (SDWA), 42 U.S.C. § 300h-2(c)(1), and the “Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties and the Revocation/Termination or Suspension of Permits” (Consolidated Rules) at 40 C.F.R. Part 22, notice is hereby given of a proposed settlement, recorded in a Consent Agreement and proposed Final Order (Proposed Consent Agreement) between the U.S. Environmental Protection Agency Region IX (EPA) and McKittrick Limited (Respondent) to resolve an administrative proceeding under Section 1423(c)(3)(B) of the SDWA, 42 U.S.C. § 300h-2(c)(3)(B).

Pursuant to 40 C.F.R. §§ 22.13(b) and 22.18(b)(2)-(3), Complainant and Respondent entered into a Proposed Consent Agreement to simultaneously commence and conclude this SDWA civil administrative proceeding.
The Proposed Consent Agreement requires Respondent to pay the United States a penalty of nineteen thousand three hundred sixty-four ($19,363) dollars. Payment of this penalty will resolve the EPA’s allegations that Respondent failed to comply with the terms of its permit by failing to timely establish and report a historic cyclic range of annular pressures during normal operating conditions in violation of its Class I Underground Injection Control permit, 40 C.F.R. § 144.51(a), and the SDWA.

Facility: The Facility is a 48-megawatt natural gas-fired power plant. Respondent injects non-hazardous treated wastewater from various processes into the Stevens Sand formation through one Class I well at depths ranging from 3,455 to 3,573 feet below ground surface.
Description of Business or Activity Conducted by the Respondent: Respondent is a company that operates a natural gas-fired peaker power plant located at 4905 Reward Road, McKittrick California.
Alleged Violations: EPA alleges that Respondent failed to comply with the terms of its permit, 40 C.F.R. § 144.51(a), and the SDWA, by failing to timely establish and report a historic cyclic range of annular pressures during normal operating conditions.
