TSCA Fees for Manufacturer-Requested Risk Evaluations

EPA requires payment of fees from chemical manufacturer(s) who request an EPA risk evaluation under TSCA section 6(b)(4)(c)(ii) and 40 CFR 702.37.  This page describes the requirements and processes related to TSCA fees for this activity.

Who Pays

For manufacturer-requested risk evaluations under TSCA section 6, the manufacturers requesting the risk evaluation are responsible for payment of the associated fees.

Fee Amounts

EPA has released a final rule revising the TSCA fees. The revised fees will be effective 60 days after the final rule is published in the Federal Register.

For a manufacturer-requested risk evaluation on a chemical included in the 2014 update to the TSCA Work Plan, the fee amount is 50% of total actual costs with a $1,250,000 initial payment.

For a manufacturer-requested risk evaluation on a chemical not included in the 2014 update to the TSCA Work Plan, the fee amount is 100% of total actual costs with a $2,500,000 initial payment.

EPA will track the actual costs associated with these individual activities and issue a final invoice (or refund) to ensure that fee payments total either 50% or 100% of the actual costs, consistent with the requirements of TSCA and the final TSCA fees rule. There is no "small business concern" discount available for this activity.

Deadline for Fee Payments

For manufacturer-requested risk evaluations under TSCA section 6, fee payments are due as follows:

  • The initial payment towards the applicable fee must be paid in full not later than 30 days after EPA provides the submitting manufacture(s) notice that it has granted the request
  • The final payment towards the applicable fee must be paid in full not later than 30 days after EPA publishes a final risk evaluation in the Federal Register.

How to Pay Fees

Fees for manufacturer-requested risk evaluations will be invoiced electronically by EPA to the requesting manufacturer(s). Invoice notices will be populated into the specific submission's Copy of Record screen in CDX and will contain a button that will initiate the payment process. When an invoice is generated for a submission, notification e-mails will be sent to the submitter's CDX inbox and the e-mail address associated with the relevant CDX account.

Payment information will be collected in CDX and then submitted to Pay.gov for processing.

Refunds

EPA will issue refunds for manufacturer-requested risk evaluations if the initial payment amount exceeds the applicable percentage of actual costs.
