EPA is archiving material relevant to the Navigable Waters Protection Rule, including this page, to avoid confusion with more recent rulemaking efforts. The Navigable Waters Protection Rule was vacated by two courts and replaced in the Federal Register. 

As part of the EPA and the Department of the Army’s efforts to review and revise the scope of the “waters of the United States,” the agencies have posted approximately 200 comment letters that were submitted during the formal consultation process, giving the public and stakeholders the opportunity to review the input the agencies received.  A summary of issues raised during federalism and tribal consultation are available here and in the docket for the Navigable Waters Protection Rule.
