Tribal Consultation Letters - Regions 9 and 10

EPA is archiving material relevant to the Navigable Waters Protection Rule, including this page, to avoid confusion with the January 2023 rulemaking efforts. For information on Tribal consultation for the January 2023 rulemaking, please click here.

As part of the EPA and the Department of the Army’s efforts to revise the definition of “waters of the United States,” the agencies have posted approximately 200 comment letters that were submitted during the formal  consultation process related to the Navigable Waters Protection Rule, giving the public and stakeholders the opportunity to review the input the agencies received.  Summaries of issues raised during tribal and federalism consultation are available here and in the docket for the Navigable Waters Protection Rule.
