Chapter 6.  Regulations on Control of Emissions through the Use of Emission Reduction Credits Banking

§615.  Schedule for Submitting Applications
Updated with revisions to LAC 33:III.615 as submitted to EPA on 
January 27, 2003 [LA007.06D] and August 14, 2009 [LA007.12J].

Unless otherwise indicated, all paragraphs are as amended in the Louisiana Register 
at LR 28:301 (February 2002) and approved by EPA September 27, 2002 (67 FR 60877) 
effective September 27, 2002 (LAd12).

    A.  All applications for banking emission reductions shall be submitted by March 31 following the year in which the reductions occurred.  ERC applications can be submitted in the form of an ERC bank application or as part of a permit application for construction or modification that requires offsets.  Failure to apply for ERCs by March 31 will invalidate the emission reductions as offsets.

    B.  All applications for banking ERCs in the parishes of
Ascension, East Baton Rouge, Iberville, Livingston, and
West Baton Rouge where the emission reductions occurred
before August 20, 1994, must have been submitted prior to
February 20, 1995. First-time applications for banking ERCs
for attainment parishes may be submitted at any time. If a
parish is redesignated as ozone nonattainment by the EPA,
application for banking ERCs for those parishes must be
submitted within six months after the effective date of the
EPA designation. Once a banking application has been filed,
the bank balance and the applicant's certification should be
submitted annually on March 1.

Paragraph C as submitted to EPA August 14, 2009 [LA007.12J]
    C.  Applications for banking emission reductions that are
to be made as part of a project that includes an increase in
emissions for which the reduction will serve to offset the
increase may be submitted as part of the permit application
for the proposed increase. Such reductions will be reviewed
for applicability as ERCs concurrently with the review of the
permit application.

Paragraph D as submitted to EPA August 14, 2009 [LA007.12J]
    D.  The applicant shall speciate VOC according to
individual compounds when applying to bank VOC
reductions. Speciation of toxic air pollutants regulated in
LAC 33:III.Chapter 51 is required.
