Federal Register Notice Announcing Schedule of Public Meetings for the Now-Vacated Navigable Waters Protection Rule

The Navigable Waters Protection Rule has been vacated and replaced in the Code of Federal Regulations (CFR) by the January 2023 rule "Revised Definition of 'Waters of the United States,'" as amended by the September 2023 rule "Revised Definition of 'Waters of the United States'; Conforming." The Navigable Waters Protection Rule is not in effect and the materials below are provided for informational purposes. Learn about the EPA and Army's more recent outreach efforts.

On August 28, 2017, the Environmental Protection Agency (EPA) and the U.S. Department of the Army published a Federal Register notice announcing ten teleconferences to hear from stakeholders their recommendations to revise the definition of ‘‘Waters of the United States’’ under the Clean Water Act. The agencies also held one in-person small entity meeting. The full schedule can be found on EPA's Pre-Proposal Outreach Meetings webpage. In addition, stakeholders were invited to submit  written recommendation on or before November 28, 2017, identified by Docket ID No. EPA–HQ–OW–2017–0480, at http://www.regulations.gov. For information on the final rule, please visit the Rule and Litigation Status webpage.
