Documents related to Proposed Consent Agreement and Proposed CAFO against Globe Metallurgical, Inc., CWA-05-2021-0004
The U.S. Environmental Protection Agency (EPA), Region 5, is providing notice of intent to execute a Consent Agreement and Final Order (CAFO) with Globe Metallurgical, Inc. (“Globe” or “Respondent”) for alleged violations of the Clean Water Act (CWA). Globe discharges pollutants to the Muskingum River through permitted outfalls according to requirements of the National Pollutant Discharge Elimination System (NPDES) Permit No. OH0007498 (“Permit”). EPA made observations during an inspection conducted at Globe Metallurgical, Inc.’s facility located at County Road 32, Beverly, Ohio (the “Facility”) on September 12, 2019 and reviewed information submitted by Globe as part of their monthly Discharge Monitoring Reports (DMRs) to the Ohio Environmental Protection Agency (Ohio EPA). EPA determined that Globe as the owner and operator of the Facility, had been discharging process wastewater in exceedance of the effluent limits as described in their Permit, in violation of the CWA, 33 U.S.C. §§ 1311.
