Summary

The U.S. Environmental Protection Agency, Region 5, is providing notice of its intent to issue a Consent Agreement and Final Order (CAFO) that assesses a civil penalty of $58,000 to Sun Chemical Corporation and Cathay Deep Well Disposal, LLC (Respondents) under the authority of Section 1423(c)(1) of the Safe Drinking Water Act (SDWA), 42 U.S.C. §300h-2(c)(1). 

The CAFO will resolve Respondent’s liability for only the civil penalty for only EPA’s allegations contained therein that Respondent failed to comply with the SDWA, 42 U.S.C. §300h, requirements of its Underground Injection Control (UIC) Permit Nos. IN-127-1I-C007 and IN-127-1I-C008 (Permits), and the UIC regulations at Title 40 of the Code of Federal Regulations Part 144 at its Class I injection wells in Porter County, Indiana. Specifically, EPA alleges in the CAFO that Respondents failed to install and maintain certain monitoring equipment, complete required monitoring and reporting, and maintain permit limitations for operation, and accepted hazardous waste for injection without authorization.
