Rule Summary

On October 13, 2026, EPA announced a proposed rule to revise the existing 2026 and 2027 small refinery exemption reallocation volumes under the Renewable Fuel Standard program in response to a higher volume of 2025 SREs than previously projected when the Agency set the renewable fuel volumes and percentage standards on April 1, 2026. One approach would reallocate the additional 2025 SRE volume equally between the 2026 and 2027 SRE reallocation volumes, while the other approach would reallocate all the additional 2025 SRE volume to the 2027 SRE reallocation volume. Additionally, given the proposed revision to the 2026 standards, this proposed action may extend the existing 2026 compliance reporting deadline of March 31, 2027.

Public Hearing

EPA will hold a virtual public hearing on November 4, 2026, for the proposed rule. This hearing will be held virtually-only (i.e., there will be no in-person hearing).

In order to attend the virtual public hearing, all attendees (including those who will not be presenting verbal testimony) must register by sending an email at RFS-Hearing@epa.gov. A separate registration form must be submitted for each person attending the hearing. Please register no later than October 28, 2026.

In order to allow everyone to be heard, EPA is limiting verbal testimony to three minutes per person. Speakers will not be able to share graphics via the virtual public hearing. Speakers will be able to request an approximate speaking time as part of the registration process, with preferences considered on a first-come, first-served basis.

If you have further questions or special needs, please contact Nick Parsons at  RFS-Hearing@epa.gov.
