Notice of Action Denying Petition for Reconsideration and Administrative Stay of the Project Emissions Accounting Rule

EPA is denying a petition for reconsideration and request for administrative stay of EPA’s November 24, 2020 final rule titled “Prevention of Significant Deterioration (PSD) and Nonattainment New Source Review (NNSR): Project Emissions Accounting” (85 FR 74890) (“Project Emissions Accounting rule”). EPA is taking no action at this time on petitioners’ request that EPA withdraw the guidance memorandum titled “Project Emissions Accounting Under the New Source Review Preconstruction Permitting Program” (March 13, 2018).
