Summary

In accordance with Section 1423(c)(3)(B) of the Safe Drinking Water Act (SDWA), 42 U.S.C. § 300h-2(c)(3)(B), the Environmental Protection Agency (EPA) is providing notice of a Proposed Administrative Compliance Order issued to Raptor Resources, LLC.

Under Section 1423(c) of the SDWA, 42 U.S.C. § 300h-2(c), the EPA is authorized to pursue actions assessing civil penalties and corrective actions for compliance for various violations of the SDWA.  The EPA provides notice of the proposed assessment of a civil penalty and corrective actions for compliance pursuant to 42 U.S.C. § 300h-2(c)(3)(B).  

In this action, EPA is proposing an Administrative Compliance Order under its authority pursuant to Section 1423 of the SDWA against Raptor Resources, LLC (Respondent). The Proposed Administrative Order alleges that the Respondent violated regulations at 40 C.F.R. §§ 147.2903(b), 147.2909, and 147.2912(a) by maintaining Well No. 10 located in Osage County, Oklahoma, in a manner that could allow the movement of fluid that contains contaminants into an Underground Source of Drinking Water and by failing to successfully demonstrate mechanical integrity.

EPA is seeking comment on this Proposed Administrative Compliance Order pursuant to Section 1423(c) of the Safe Drinking Water Act. EPA will consider all comments received in determining its final action.
