If you believe that any condition of the draft permit is inappropriate, you must raise all reasonably ascertainable issues and submit all arguments supporting your position during the 30-day public comment period. Any supporting documents must be included in full and may not be incorporated by reference, unless they are already part of the administrative record for this draft permit or consist of tribal, state, or federal statutes or regulations, or other generally available reference materials. EPA may grant an extension of the 30-day comment period if the request for an extension adequately explains why more time is required to prepare comments. All comments received prior to the end of the public comment period and all comments made during a public hearing will be considered in arriving at a final decision on renewal of the permit.

All comments that are received via email or through www.regulations.gov will be included in the public docket without change and will be available to the public, including any personal information provided. Comments submitted to EPA through a non-electronic delivery method will also be included in the public docket without change and will be available to the public, including any personal information provided, unless the comment includes Confidential Business Information (CBI) or other information the disclosure of which is restricted by statute. Summary

Request for public comment on draft Clean Air Act Minor New Source Review Permit in Indian Country for Jamul Casino Resort, San Diego County, CA .

Proposed Action

Consistent with the Federal Minor New Source Review (NSR) regulations in Indian Country (40 CFR §§49.151-161), the Region 9 office of the United States Environmental Protection Agency (EPA) provides notice and requests public comment on a draft Clean Air Act (CAA) Tribal Minor New Source Review (NSR) Permit (draft permit) for Jamul Casino Resort, an enterprise of the Jamul Indian Village Development Corporation. The Jamul Casino Resort is a gaming facility, located at 14145 Campo Road, Jamul, California, 91935, which is approximately 20 miles east of downtown San Diego. The Jamul Casino, previously named the Hollywood Casino, began construction in 2014 and opened in 2016. The facility recently expanded to include an adjoining 16-floor hotel and resort, including dining, bar, spa, roof top pool deck, fitness center and banquet facilities, which opened in August 2025.

Equipment at the casino includes two (2) 2,180 kilowatts (kW) engine-generator sets (gen-sets), four (4) boilers, and three (3) water heaters. The hotel has two (2) gen-sets (an 829-kW unit used at the hotel and a 568-kW unit used at the wastewater treatment plant), and three (3) additional boilers used at the hotel. All gen-sets are used for emergency backup power only.

Request for Public Comment

Pursuant to 40 CFR 49.157(b), EPA is opening a 30-day public comment period to provide the affected community and the general public an opportunity to comment on the draft permit. During the public comment period, any person may submit written comments on the draft permit and our finding under section 106 of the National Historic Preservation Act and may request a public hearing. The application, draft permit, technical support document, and all other supporting materials for the draft permit, including all data submitted by the applicant, are available through the EPA Region 9 website, or at www.regulations.gov under Docket ID No. EPA-R09-OAR-2025-0454.  Members of the public may also obtain relevant materials by contacting La Weeda Jones, as provided in the Contact Information section below.

Public Hearing

EPA has not scheduled a public hearing for the draft permit action. However, any person may submit a written request for a public hearing, using the methods identified below, by stating the nature of the issues to be raised at the public hearing. EPA will hold a public hearing if EPA finds, on the basis of requests, a significant amount of public interest in the draft permit. If a public hearing is held, EPA will provide public notice at least 30 days in advance of the date and time of any scheduled public hearing. At a public hearing, any person may submit oral or written statements and data concerning the draft permit. The 30-day public comment period would be extended to the close of any public hearing on the draft permit.

Final Action 

Before taking final action on the draft permit, EPA will consider all comments received during the public comment period and all comments made during any public hearing in arriving at a final decision on the draft permit. The final permit is a public record that can be obtained by request. A statement of reasons for any changes made to the draft permit and responses to comments received will be sent to all persons who commented on the draft permit. EPA’s final permit decision will become effective 30 days after the service of notice of the decision unless:

  1. A later effective date is specified in the permit;
  2. The decision is appealed to EPA’s Environmental Appeals Board (EAB) pursuant to 40 CFR §49.159(d); or
  3. There are no comments requesting a change to the draft permit decision, in which case the final decision may become effective immediately upon issuance.

Appeals to the Environmental Appeals Board (EAB)

In accordance with 40 CFR §49.159 and 40 CFR §124.19, within 30 days after EPA issues a final permit decision, any person who filed comments on the draft permit or participated in the public hearing may petition the EAB to review any condition of the permit decision. The 30-day period within which a person may request review under this section begins when the Region has fulfilled the notice requirements for the final permit decision. A petition to the EAB is, under section 307(b) of the Act, a prerequisite to seeking judicial review of the final agency action. For purposes of judicial review, final agency action occurs when EPA denies or issues a final permit and agency review procedures are exhausted.
