    This Economic Impact Assessment (EIA) demonstrates that DOE’s strategy for development and design of a possible repository at Yucca Mountain has evolved so that the EPA’s 40 CFR Part 197 standards will have no impact on costs of the repository or the repository development program.

    The U.S. Circuit Court of Appeals determined that the 10,000-year regulatory period (the period covered by the standards) was not "based upon and consistent with" the NAS report's recommendation and vacated that portion of EPA's Yucca Mountain standards.
