Final Decision Granting an Application for a Non-waste Determination Regarding Benson Power, LLC Poultry Litter
This document provides EPA's final decision granting a July 1, 2013 application submitted by Benson Power, LLC (formerly known as FibroMinn, LLC) for a non-waste determination under the RCRA Non-hazardous Secondary Material rule found at 40 Code of Federal Regulations 241.3(c). The decision applies to poultry litter burned as fuel in the boilers at the Benson, Minn. power plant to produce electricity.
