Regulations for Greenhouse Gas Emissions from Passenger Cars and Trucks

EPA is issuing a Direct Final Rule that would correct an error in EPA’s regulations for test procedures used in the Corporate Average Fuel Economy (CAFE) program finalized in a 2012 rulemaking. EPA established the procedures under the Energy Policy and Conservation Act (EPCA) which authorizes EPA to establish test and calculation procedures for CAFE. The correction clarifies the method for how E85 flex-fuel vehicles (FFVs) are accounted for in manufacturer fuel economy calculations for model years 2020 and later. This correction allows the program to be implemented as originally intended in the 2012 rule.

This action is being taken without prior proposal, as a direct final rule, because EPA believes that this final rulemaking is noncontroversial, for the reasons set forth in the preamble, and due to the limited scope of this action. EPA is also publishing a separate document that will serve as the proposed rule in the event adverse comments are received. If no adverse comments are received, EPA will take no further action on the proposed rule.
