EPA announces support of the Tenth Circuit Court of Appeals’ 2020 decision in Renewable Fuels Association et al. v. EPA. This is a change in EPA’s position from that taken in the Tenth Circuit and reflects a careful review of that court’s reasoning and Congress’s intent in establishing the RFS program.
