Electric Utility Generating Units: Repealing the Clean Power Plan: Proposal

EPA is proposing to repeal the Clean Power Plan - after completing a thorough review as directed by the Energy Independence Executive Order. EPA proposes a change in the legal interpretation as applied to section 111(d) of the Clean Air Act, on which the CPP was based, to an interpretation that is consistent with the Act’s text, context, structure, purpose, and legislative history, as well as with EPA’s historical understanding and exercise of its statutory authority. EPA will accept comment on the proposal until January 16, 2018.
