All comments will be considered for the final decision, and responses will be part of the administrative record. The EPA will hold a hearing if there is significant public interest, with a 30-day notice provided.

Summary

The U.S. Environmental Protection Agency is proposing to issue an Underground Injection Control (UIC) permit related action, under the authority of the Safe Drinking Water Act and UIC Program regulations, that would authorize Middle Fork Energy Uinta, LLC to construct two Class II disposal wells to inject produced water from oil and gas operations in the Red Wash Field in Uintah County, Utah. The proposed Class II Permits will authorize Middle Fork Energy Uinta, LLC to operate SWD 33-33-723 and SWD 44-32-723. The proposed injection zone is the Birds Nest Aquifer formation. The SWD 33-33-723 well will be approximately 3,621 feet deep and USDWs are protected by the upper confining zone that has approximately 368 feet of confining shales and the lower confining zone that has approximately 127 feet of confining shales. The SWD 44-32-723 well will be approximately 3,697 feet deep and USDWs are protected by the upper confining zone that has approximately 365 feet of confining shales and the lower confining zone that has approximately 127 feet of confining shales.
