Draft Clean Water Act Section 106 Tribal Grant Guidance

The Draft Clean Water Act Section 106 Tribal Grant Guidance (Section 106 Tribal Guidance) will update and replace the Final Guidance on Awards of Grants to Indian Tribes under Section 106 of the Clean Water Act for Fiscal Years 2007 and Beyond.

The draft Section 106 Tribal Guidance reflects advances in tribal water quality programs over the last 15 years and provides Tribes with more accurate, comprehensive, and up to date information to support tribal water quality programs. Including:

  • Updated grant, programmatic, and technical content
  • Improved overall structure to reflect the natural program progression
  • Added information on other EPA programs and topics
  • Increased flexibility for meeting program requirements

What is the status of the revision?

Consultation was initiated in January 2021. A work group made up of EPA and tribal members developed the draft Clean Water Act Section 106 Tribal Grant Guidance. The draft Section 106 Tribal Guidance is currently available for public comment.

  • The comment period will remain open from June 13, 2022 through October 14, 2022.
  • On July 29, 2022, the Comment Period Extension Letter and the Revision Project Status Update #6 were sent to tribal leaders:

  • EPA hosted an informational webinar on June 29, 2022, to provide an overview of the revision process and revised Guidance, explain how to provide comments and request government-to-government consultation, and provide an opportunity to ask questions and provide initial feedback. The webinar was also offered on June 23, 2022, and covered the same material.
