Description of Business or Activity Conducted by the Respondent: Respondent operates a recycling facility located at 209 E. Harmon Industrial Park Road in Tamuning, GU 96913. The facility discharges industrial stormwater through various conveyances that discharge into the Agana Bay and Tumon Bay.

Summary of Alleged Violations: EPA alleges that Respondent violated CWA Section 301 by discharging industrial stormwater to waters of the United States without authorization on multiple occasions between January 2019 and August 2021. The Respondent has since obtained NPDES permit coverage in compliance with the CWA and has addressed pollution prevention issues and made structural changes to the facility to minimize pollutant discharges in accordance with the permit.
