Action Code Interpretation

This category applies to an application that proposes to add an inert ingredient to the Commodity Inert Ingredient List. The inert ingredient must be on EPA’s list of approved nonfood inert ingredients or have an established tolerance or exemption from tolerance for use as an inert ingredient published in 40 CFR part 180. Also, the substance must not be an active ingredient or be subject to data compensation (Chemicals currently on the commodity list will remain on the commodity list, unless EPA identifies safety issues that require their removal). The substance must be available from multiple commercial sources (at least 3) and it must not be a mixture or proprietary blend.
