Reissuance of EPA Dewey-Burdock Class III and Class V Injection Well Area Permits (March 14, 2025)

The U.S. Environmental Protection Agency (EPA) issued two Underground Injection Control (UIC) Area Permits for injection activities related to the Dewey-Burdock Project in the southern Black Hills of South Dakota on November 24, 2020.  One is a Class III Area Permit for injection wells used for the in-situ recovery (ISR) of uranium, and the other is a Class V Area Permit for deep injection wells that will be used to dispose of ISR process waste fluids. Information on these 2020 Permits and associated documents can be found at this weblink: 2020 Permits. These Permits were appealed to the Environmental Appeals Board (EAB).

In response to an Order by the EAB to remand the Permits in part, the EPA has reviewed its documents and added to the administrative record, revised its response to comments document, and is reissuing the Final Permits with no changes. Documents added to the administrative record can be found at the end of the Index. The EPA is making supporting material related to the Final Dewey-Burdock UIC Class III and Class V Area Permits, reissued March 14, 2025, available for public access.
