Model Provisions: RCRA 3008(h) AOC - financial assurance provisions
Transmittal memorandum and model language provisions addressing financial assurance in the section 3008(h) Resource Conservation and Recovery Act (RCRA) administrative order on consent (AOC). Issued 2/8/2006.
The 2006 FA language is incorporated into the 2016 revised model RCRA § 3008(h) AOC with minor typographical corrections as Section XV (Financial Assurance). The FA language in the model requires facility owners or operators who enter into corrective action agreements under RCRA § 3008(h) to provide cost estimates for the work to be performed and assurances of financial responsibility to complete the work required by the order.
