Approval Issued

On February 14, 2019, EPA granted renewal and modification to a PCB Chemical Waste Landfill Approval for the Wayne Disposal, Inc. landfill located at 49350 N I-94 Service Drive, Belleville, Michigan. This approval was issued following a public comment period and hearing. On the renewal and modification web page, the following documents can be accessed:

Background

The US Ecology, Wayne Disposal, Inc. (WDI) facility would be allowed to modify the liner design for a cell of its landfill if a proposed modification to its existing approval is granted by the U.S. Environmental Protection Agency (EPA).  The modification would occur within the original boundaries of the facility located at 49350 North I-94 Service Drive, Belleville, MI.  In May 2018, WDI requested that the EPA modify the company’s existing approval for a chemical waste landfill to dispose of polychlorinated biphenyls (PCBs). 

WDI first received approval to dispose of PCBs in the company’s chemical waste landfill in 1997. Permission to manage PCBs was last renewed in 2013. Approval of the liner modification request would allow WDI to continue to develop its PCB capacity of 12 million cubic yards. The liner modification would be located in a cell of the landfill which has been previously approved to accept PCB wastes. EPA regulates PCB disposal under the federal Toxic Substances Control Act (TSCA).

The landfill is also supervised by MDEQ and received a state operating permit for the landfill in May 2012.      

After reviewing WDI’s request, EPA tentatively plans to approve the application. Agency experts believe the company has shown that the modification is as protective as the previous liner design and does not present a risk to people or the environment. The approval outlines specific conditions under which WDI must operate the facility.

Before a final decision is made, EPA took comments from the public on the proposed approval for WDI located at 49350 North I-94 Service Drive, Belleville, Michigan.

The draft PCB commercial storage approval was open for public comment from June 28, 2018 to July 31, 2018. A public hearing, hosted jointly by MDEQ and EPA, was held on July 19, 2018. The slides presented by MDEQ and EPA, as well as CTI & Associates, at the public hearing have been posted online.

Copies of the draft PCB chemical waste landfill approval and supporting documents (i.e., WDI application) are located at the Van Buren Charter Township Hall as well as posted online (further information is below). Comments were accepted on the draft EPA approval, not the supporting documents.
