Respondent: Transport Products Unlimited, Inc., 225-B Bennett Ave., Vallejo, CA 94590.

Description of Business or Activity Conducted by the Respondent: Respondent operates a shipping container modification and fabrication facility located at 225-B Bennett Ave., Vallejo, CA 94590. The facility discharges into the City of Vallejo’s municipal separate storm sewer system, which flows through the Napa River and into the Pacific Ocean.

Summary of Alleged Violations: EPA alleges that Respondent violated CWA Section 301 by discharging industrial stormwater from its facility to waters of the United States without CWA authorization on multiple occasions between January 2010 and October 2023. The Respondent has since made structural changes to the facility to prevent exposure of industrial activities to stormwater in accordance with the eligibility requirements of the No Exposure Certification and has submitted the required registration documents to the California State Water Resources Control Board via Stormwater Multiple Application and Report Tracking System (SMARTS).

Proposed Penalty: $7,500
