Summary

Purpose of Public Notice

This notice serves to state the intention of the U.S. Environmental Protection Agency, Region 8, (“EPA Region 8”) to issue one (1) Underground Injection Control (UIC) Class VI injection well permit under the authority of the Safe Drinking Water Act (SDWA) and UIC Program regulations 40 CFR Parts 124, 144-146 and an associated injection depth waiver for injection into the Lyons formation. EPA is also providing public notice for a public hearing on this project, as described below.

The proposed Class VI permit is for one (1) Class VI injection well (Front Range 1-1) that will be used to inject carbon dioxide for the purpose of geologic sequestration near Windsor, Colorado in Weld County. The proposed permit requires, among other things, that the permittee monitor the injection project and submit periodic reports to EPA Region 8. Ongoing monitoring requirements are designed to ensure protection of underground sources of drinking water (USDW).

Injection Depth Waiver Information

The EPA is providing notice to the public that CSS has submitted an Injection Depth Waiver application for this project. Class VI permit applicants who intend to sequester CO2 in reservoirs above the lowermost USDW must submit an injection depth waiver application in accordance with 40 CFR § 146.95. CSS submitted information regarding the injection zone, upper and lower confining zones, well construction, computational modeling, and plans for monitoring and testing to demonstrate that USDWs above and below the injection zone will not be endangered as a result of fluid movement.

Public Water Supplies Affected or in the Area of Review: 
There are no public water supplies reasonably likely to be affected by the injection or served by USDWs in the area of review.

Consultation Results: 
The EPA Region 8 consulted with the Colorado Department of Public Health and the Environment (CDPHE) Public Water System Supervision (PWSS) program in accordance with 40 CFR § 146.95(b)(2). The purpose of this consultation was to ascertain whether the Ingleside Formation, which underlies the proposed injection zone, is currently being utilized or is planned to be utilized as a drinking-water resource in the future. Currently no communities are utilizing the Ingleside Formation or have plans to do so. The PWSS Director cited the depth and highly variable water quality of the Ingleside as constraints on utilizing the aquifer as a resource in the regional area surrounding the FRSC.

Public Comments

In accordance with the requirements of 40 CFR 124.10, the public is invited to comment on these actions submitting written comments online at www.regulations.gov under Docket # EPA-R08-OW-2026-1915.

All comments must be submitted to EPA Region 8 and received prior to the end of the comment period to be considered in the formulation of any final permit determinations. Comments must be received by 11:59 p.m. Mountain Standard Time (MST) on April 28, 2026.

Each commenter will have three minutes to provide oral testimony.  

The EPA recommends submitting the text of your oral comments as written comments to the rulemaking docket identified by Docket ID No. EPA-R08-OW-2026-1915 at https://www.regulations.gov.

The EPA will make every effort to accommodate all speakers who register, although preferences on speaking times may not be able to be fulfilled. The EPA may ask clarifying questions during the oral presentations but will not respond to the presentations at that time. Written statements and supporting information submitted during the comment period will be considered with the same weight as oral comments and supporting information presented at the public hearing.  

The EPA will make every effort to follow the schedule as closely as possible on the day of the hearing; however, please plan for the hearing to run either ahead of schedule or behind schedule. 

If you require the services of an interpreter or special accommodation such as audio description, please pre-register and describe your needs by April 20, 2026. The EPA may not be able to arrange accommodation without advance notice.
