EPA Adjusts Annual Pesticide Registration Maintenance Fee to Meet Statutory Direction

The U.S. Environmental Protection Agency (EPA) is issuing a notification informing pesticide registrants of a decrease in the annual pesticide registration maintenance fee. To meet statutory requirements, the fee for each pesticide product registered during fiscal year 2023 will be $3,400, down from $3,660 in fiscal year 2022.

The Pesticide Registration Improvement Extension Act of 2018 (PRIA 4) directs EPA to collect, to the extent practicable, an average amount of $31 million in pesticide registration maintenance fees annually for fiscal years 2019-2023, or a total of $155 million. EPA has collected $124.2 million to date.

As seen in the table below EPA only has $30.8 million remaining to collect. The Agency collected more than the target amount from fiscal years 2020-2022 due to an unexpected influx of new product applications in response to SARS-CoV-2 (the virus that causes COVID-19). To avoid overcollection, EPA is thus required to reduce the fee amount for fiscal year 2023.

All registrants with Section 3 and Section 24(c) pesticide product registrations will receive an email to notify them of this change. Registrants will need to access their product filing forms, pay maintenance fees and return completed documents to EPA for processing by Jan. 17, 2023.
