Enforcement of Lead Laws and Regulations in Region 4

EPA’s Region 4 office serves Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, and Tennessee 

FY 2024 Lead Enforcement and Regional Geographic Initiatives Highlights

Toxic Substances Control Act

Region 4 Enforcement and Compliance Assurance Division conducted 230 inspections, 129 of which were conducted in properties owned by property management companies (PMCs). The region concluded 24 administrative penalty orders and assessed more than a $200,000 in civil penalties in FY 2024.   

Geographic Initiatives: Charleston, South Carolina and Miami, Florida area are the two Geographic Initiative locations in Region 4. In FY 2024, 116 inspections were conducted in the Charleston area with six administrative penalty orders issued. In the Miami area, 38 inspections were conducted and six administrative penalty orders were issued. 

Property Management Companies (PMCs) case highlights:

On June 13, 2024,  Region 4 filed a Compliance Agreement and Final Ordre (CAFO) with Sound City Realty, LLC, based in Nashville, Tennessee to resolve alleged violations of the Lead-Based Paint Rules in connection with the leasing and renovation of target housing in the state of Tennessee. Sound City paid a civil penalty in the amount of $27,400. Sound City Realty’s portfolio includes the management of 135 doors of target housing, comprised primarily of single-family homes. 

On August 19, 2024,  Region 4 filed a CAFO with Copper Roof Property Management, LLC, based in Mount Pleasant, South Carolina to resolve alleged violations of the Lead-Based Paint Rules at 40 C.F.R. Part 745, Subparts E and F, in connection with the leasing and renovation of target housing in the States of Georgia and Florida. Pursuant to the CAFO, Copper Roof paid $31,800. This enforcement action impacts overburdened communities in the Charleston, South Carolina area, one of Region 4’s geographic initiative areas. 

On September 4, 2024,  Region 4 filed a CAFO with Strategic Properties, LLC, based in Miami, Florida, to resolve alleged violations of the Lead-Based Paint Rules in connection with the leasing and renovation of target housing in the States of Georgia and Florida. Pursuant to the CAFO, Strategic Properties will pay $41,200. Strategic Properties manages 778 units of target housing in a mixture of single family, duplexes, and multifamily properties. This enforcement action impacts overburdened communities in Miami, Florida, one of Region 4’s geographic initiative areas
