EPA Position Regarding Issuance of Imminent and Substantial Endangerment Orders at DOW Facilities

The Department of Justice's response to Department of Defense's (DOW) May 15, 2008, letter requesting the Attorney General to resolve a dispute between EPA and DOW concerning four "imminent and substantial endangerment" orders issued by EPA under the Resource Conservation and Recovery Act (RCRA) and the Safe Drinking Water Act (SDWA) at DOW facilities listed on the National Priorities List (NPL).
